Bush Advisor Says President Has Legal Power to Torture Children
By Philip Watts 01/08/06 "revcom.us" -- -- “John Yoo publicly argued there is no law that could prevent the President from ordering the torture of a child of a suspect in custody – including by crushing that child’s testicles. This came out in response to a question in a December 1st debate in Chicago with No tre Dame professor and international human rights scholar Doug Cassel.

What is particularly chilling and revealing about this is that John Yoo was a key architect post-9/11 Bush Administration legal policy. As a deputy assistant to then-Attorney General John Ashcroft, John Yoo authored a number of legal memos arguing for unlimited presidential powers to order torture of captive suspects, and to declare war anytime, any where, and on anyone the President deemed a threat. It has now come out Yoo also had a hand in providing legal reasoning for the President [sic] to conduct unauthorized wiretaps of U.S. citizens. Georgetown Law Professor David Cole wrote, "Few lawyers have had more influence on President Bush’s legal policies in the 'war on terror’ than John Yoo."
This part of the exchange during the debate with Doug Cassel, reveals the logic of Yoo’s theories, adopted by the Administration as bedrock principles, in the real world.
Cassel: If the President deems that he’s got to torture somebody, including by crushing the testicles of the person’s child, there is no law that can stop him?
Yoo: No treaty.
Cassel: Also no law by Congress. That is what you wrote in the August 2002 memo.
Yoo: I think it depends on why the President [sick] thinks he needs to do that.

“We received an e mail from "Scott", a member of a pipefitters union that runs an apprenticeship program called Helmets To Hard Hats, which according to its website, "Is a national program that connects National Guard, Reserve and transitioning active-duty military members with quality career training and employment opportunities within the construction industry."  Scott writes that his company hired a soldier who had recently returned from Iraq, who told him that U.S. troops were being quizzed on whether or not they would be prepared to shoot their own friends and family members during a national state of emergency in America.

 "I have become very close to this young man and have gained his respect and trust," writes Scott. "I want you to know that he informed me about one particular training exercise his superiors made them perform. It was concerning the rounding up of American citizens that disobey any type of martial law or in other words any type of infringement on our freedoms. "He was asked if he could shoot his friends or family members if ordered to do so. At the time he said he could," writes Scott. Scott says that the soldier later "had time to clear his head" and realize the truth, recanting his vow to kill his own countrymen if ordered to do so.

 The issue of whether U.S. troops would be prepared to round-up, disarm and if necessary shoot Americans who disobeyed orders during a state of martial law is a question that military chiefs have been attempting to answer for at least 15 years. Its known origins can be traced back to an October 1994 Marine questionnaire out of the Twentynine Palms Marine Base in California. Recruits were asked 46 questions, including whether they would kill U.S. citizens who refused to surrender their firearms.

Documentary film maker Alex Jones brought to light similar training programs that were taking place across the country in the late 90's which revolved around U.S. Marines being trained to arrest American citizens and take them to internment camps. During one such program in Oakland California, dubbed "Operation Urban Warrior," Marines refused to answer if they would target American citizens for gun confiscation if ordered to do so.

 During hurricane Katrina, National Guard units were ordered to confiscate guns belonging to New Orleans residents.

 As we first exposed in May 2006, Clergy Response Teams are being trained by the federal government and FEMA to "quell dissent" and pacify citizens to obey the government in the event of a declaration of martial law.

Pastors and other religious representatives are being taught to become secret police enforcers who teach their congregations to "obey the government" in preparation for the implementation of martial law, property and firearm seizures, mass vaccination programs and forced relocation.

 Many scoffed at our original story, which was based on the testimony of a whistleblower who was asked to participate in the program. Claims that the story was a conspiracy theory soon evaporated when a mainstream KSLA news report confirmed the existence of the program.

The experiences of U.S. troops in the worst areas of Iraq, where soldiers are ordered to go door to door and arrest all men of military age as well as confiscate their weapons, is a mere portend of what is being planned for America if these training programs ever come to fruition.”

As a citizen, exercising a citizen’s right and duty to contact Our Congress, I called and was surprised to find that many of the Congressional aids did not know that John Yoo is the co-author of the unconstitutional “Patriot Act” and that he serves as Bush’s attorney. I was even more surprised to find that the aids seemed uninterested, and on a few occasions, argumentative, when they are asked what the congressperson thinks about Yoo claiming that Bush can torture kids. 

 

 

 

 

 

I had thought that the job of the congressional aids was to politely note citizen concerns, and pass the concerns on to the congressperson. Instead, one of the aids actually began to take up for Bush, and say that Bush wouldn’t torture kids. I was so disappointed that an aid was belittling this topic, and thus enabling Bush to continue to torture kids, that I ended the phone call. (I hung up). I thought of all the families destroyed by bush co., the ones in Iraq, Afghanistan, in our own country during Katrina. I thought of the indifferent behavior, sometimes showing contempt for citizens, on the part of people who are supposed to be public servants. This is a story in itself, I thought. Thus, later that day, I began calling Congress as the editor of The Daily Paradise, working on a story about torture. In this case, I was always directed to the press secretary, or someone in that capacity.

He said that is why she didn’t vote for the new attorney general.

 

 

 

 

 

Matt did express his concern regarding my calling Patty’s office and “threatening” to quote one of the staff, who is not supposed to discuss policy, but only supposed to take down a citizen’s concerns, and pass them along to Patty. Matt said this was unprofessional.

 

 

 

 

 

I replied that I agreed that the aid is only supposed to take down a citizen’s concerns, but the behavior I expected from a public servant didn’t happen when I called Patty’s office. Instead, the aid began to give his opinion that even if Bush had the power to torture kids, that Bush wouldn’t use the power.

 

 

 

 

 

Of course, the aid is welcome to his opinion, leaving only the question of why the aid isn’t working for Bush.

 

 

 

 

 

I explained to Matt that this is the story, that a citizen like me calls to give an opinion and the aid begins to disagree, rather than simply pass the information to Patty.

 

 

 

 

 

I also asked why it was so hard to call Patty’s DC office, with a phone recording announcement, without a leave-a-message capability. Matt explained that Patty is busy. I replied that other senators, such as Kennedy and Kerry and Cantwell are also busy, but someone always answers the phone. At this, Matt said he apologized for this situation.

According to the United States Constitution, Article 1, only Congress shall make Federal Laws. However, since the "War and Emergency Powers Act" of 1932, every President has usurped the lawmaking powers of Congress by creating Presidential "laws" called "Executive Orders." These Executive Orders, not our Constitution, have been governing America ever since.

 

 

 

 

 

 The "War and Emergency Powers Act" decrees that the President alone can declare a National Emergency and essentially become a dictator. The President can also declare a "war" on anything and thereby also give himself dictatorial control.  For example, the "War On Drugs" makes it possible to use Federal authorities, such as FBI, FEMA, BATF, and the U.S. Military against American citizens even though these agencies have no authority to do so under the Constitution. A particulary gruesome example of this would be Waco. Another example would be hurricane Opal. After Florida was declared to be in a state of National Emergency, FEMA was brought in and all citizens were put under Marshal Law and restricted to the point they could not go outside their own front doors. This was utterly un-Constitutional.

 

 

 

 

 

 The "War and Emergency Powers Act" is a treasonous act on the part of our government, passed so Presidents can bypass the Congress and do whatever they choose. It also makes it possible to do away with the "posse comitatus" in cases of "emergency". The "posse comitatus" is what protects the American citizens from the military being turned on them. In Germany, the military and the Gestapo were turned on German citizens. Now, in an "emergency", the U.S. military can be turned on the American citizens. The Federal Government has its own Gestapo in the form of the FBI, the BATF, and FEMA.

 

 

 

 

 

 These Executive Orders have not been widely publicized, and most Americans are completely unaware of them. If they were aware of what has been going on, most of the 250 million Americans would not tolerate it for another minute. Interestingly, copies of these illegal, un-Constitutional Executive Orders are available to the American public. They are all printed in the U.S. Federal Register and have the force of law when activated by a President. Truth has a way of asserting itself despite all attempts to obscure it.  Distortion only serves to derail it for a time.  No matter to what lengths we humans may go to obfuscate facts or delude our fellows, truth has a way of squeezing out through the cracks, eventually.

 

 

 

 

 

But the danger is that at some point it may no longer matter.  The danger is that damage is done before the truth is widely realized.  The reality is that, sometimes, it is easier to ignore uncomfortable facts and go along with whatever distortion is currently in vogue.  We see a lot of this today in politics.  I see a lot of it -- more than I would ever have believed -- right on this Senate Floor.

 

 

 

 

 

Regarding the situation in Iraq, it appears to this Senator that the American people may have been lured into accepting the unprovoked invasion of a sovereign nation, in violation of long-standing International law, under false premises.  There is ample evidence that the horrific events of September 11 have been carefully manipulated to switch public focus from Osama Bin Laden and Al Queda who masterminded the September 11th attacks, to Saddam Hussein who did not.  The run up to our invasion of Iraq featured the President and members of his cabinet invoking every frightening image they could conjure, from mushroom clouds, to buried caches of germ warfare, to drones poised to deliver germ laden death in our major cities.  We were treated to a heavy dose of overstatement concerning Saddam Hussein's direct threat to our freedoms.  The tactic was guaranteed to provoke a sure reaction from a nation still suffering from a combination of post traumatic stress and justifiable anger after the attacks of 911.  It was the exploitation of fear.  It was a placebo for the anger.

 

 

 

 

 

Since the war's end, every subsequent revelation which has seemed to refute the previous dire claims of the Bush Administration has been brushed aside.  Instead of addressing the contradictory evidence, the White House deftly changes the subject.  No weapons of mass destruction have yet turned up, but we are told that they will in time.  Perhaps they yet will.  But, our costly and destructive bunker busting attack on Iraq seems to have proven, in the main, precisely the opposite of what we were told was the urgent reason to go in.  It seems also to have, for the present, verified the assertions of Hans Blix and the inspection team he led, which President Bush and company so derided.  As Blix always said, a lot of time will be needed to find such weapons, if they do, indeed, exist.  Meanwhile Bin Laden is still on the loose and Saddam Hussein has come up missing.

 

 

 

 

 

The Administration assured the U.S. public and the world, over and over again, that an attack was necessary to protect our people and the world from terrorism.  It assiduously worked to alarm the public and blur the faces of Saddam Hussein and Osama Bin Laden until they virtually became one.

 

 

 

 

 

What has become painfully clear in the aftermath of war is that Iraq was no immediate threat to the U.S.  Ravaged by years of sanctions, Iraq did not even lift an airplane against us.  Iraq's threatening death-dealing fleet of unmanned drones about which we heard so much morphed into one prototype made of plywood and string.  Their missiles proved to be outdated and of limited range.  Their army was quickly overwhelmed by our technology and our well trained troops.

 

 

 

 

 

Presently our loyal military personnel continue their mission of diligently searching for WMD. They have so far turned up only fertilizer, vacuum cleaners, conventional weapons, and the occasional buried swimming pool.  They are misused on such a mission and they continue to be at grave risk.  But, the Bush team's extensive hype of WMD in Iraq as justification for a preemptive invasion  has become more than embarrassing.  It has raised serious questions about prevarication and the reckless use of power.  Were our troops needlessly put at risk?  Were countless Iraqi civilians killed and maimed when war was not really necessary?  Was the American public deliberately misled?  Was the world? 

 

 

 

 

 

What makes me cringe even more is the continued claim that we are "liberators." The facts don't seem to support the label we have so euphemistically attached to ourselves.  True, we have unseated a brutal, despicable despot, but "liberation" implies the follow up of freedom, self-determination and a better life for the common people.  In fact, if the situation in Iraq is the result of "liberation," we may have set the cause of freedom back 200 years.

 

 

 

 

 

Despite our high-blown claims of a better life for the Iraqi people, water is scarce, and often foul, electricity is a sometime thing, food is in short supply, hospitals are stacked with the wounded and maimed, historic treasures of the region and of the Iraqi people have been looted, and nuclear material may have been disseminated to heaven knows where, while U.S. troops, on orders, looked on and guarded the oil supply.

 

 

 

 

 

Meanwhile, lucrative contracts to rebuild Iraq's infrastructure and refurbish its oil industry are awarded to Administration cronies, without benefit of competitive bidding, and the U.S. steadfastly resists offers of U.N. assistance to participate.  Is there any wonder that the real motives of the U.S. government are the subject of worldwide speculation and mistrust?

 

 

 

 

 

And in what may be the most damaging development, the U.S. appears to be pushing off Iraq's clamor for self-government.  Jay Garner has been summarily replaced, and it is becoming all too clear that the smiling face of the U.S. as liberator is quickly assuming the scowl of an occupier.  The image of the boot on the throat has replaced the beckoning hand of freedom.  Chaos and rioting only exacerbate that image, as U.S. soldiers try to sustain order in a land ravaged by poverty and disease.  "Regime change" in Iraq has so far meant anarchy, curbed only by an occupying military force and a U.S. administrative presence that is evasive about if and when it intends to depart.

 

 

 

 

 

Democracy and Freedom cannot be force fed at the point of an occupier's gun.  To think otherwise is folly.  One has to stop and ponder.  How could we have been so impossibly naive?  How could we expect to easily plant a clone of U.S. culture, values, and government in a country so riven with religious, territorial, and tribal rivalries, so suspicious of U.S. motives, and so at odds with the galloping materialism which drives the western-style economies?

 

 

 

 

 

As so many warned this Administration before it launched its misguided war on Iraq, there is evidence that our crack down in Iraq is likely to convince 1,000 new Bin Ladens to plan other horrors of the type we have seen in the past several days.  Instead of damaging the terrorists, we have given them new fuel for their fury.  We did not complete our mission in Afghanistan because we were so eager to attack Iraq.  Now it appears that Al Queda is back with a vengeance. We have returned to orange alert in the U.S., and we may well have destabilized the Mideast region, a region we have never fully understood.  We have alienated friends around the globe with our dissembling and our haughty insistence on punishing former friends who may not see things quite our way. 

 

 

 

 

 

The path of diplomacy and reason have gone out the window to be replaced by force, unilateralism, and punishment for transgressions.  I read most recently with amazement our harsh castigation of Turkey, our longtime friend and strategic ally.  It is astonishing that our government is berating the new Turkish government for conducting its affairs in accordance with its own Constitution and its democratic institutions.

 

 

 

 

 

Indeed, we may have sparked a new international arms race as countries move ahead to develop WMD as a last ditch attempt to ward off a possible preemptive strike from a newly belligerent U.S. which claims the right to hit where it wants.  In fact, there is little to constrain this President.  Congress, in what will go down in history as its most unfortunate act, handed away its power to declare war for the foreseeable future and empowered this President to wage war at will.

 

 

 

 

 

As if that were not bad enough, members of Congress are reluctant to ask questions which are begging to be asked.  How long will we occupy Iraq?  We have already heard disputes on the numbers of troops which will be needed to retain order.  What is the truth?  How costly will the occupation and rebuilding be?  No one has given a straight answer.  How will we afford this long-term massive commitment, fight terrorism at home, address a serious crisis in domestic healthcare, afford behemoth military spending and give away billions in tax cuts amidst a deficit which has climbed to over $340 billion for this year alone?  If the President's tax cut passes it will be $400 billion.  We cower in the shadows while false statements proliferate.  We accept soft answers and shaky explanations because to demand the truth is hard, or unpopular, or may be politically costly. 

 

 

 

 

 

But, I contend that, through it all, the people know.  The American people unfortunately are used to political shading, spin, and the usual chicanery they hear from public officials.  They patiently tolerate it up to a point.  But there is a line.  It may seem to be drawn in invisible ink for a time, but eventually it will appear in dark colors, tinged with anger.  When it comes to shedding American blood - - when it comes to wreaking havoc on civilians, on innocent men, women, and children, callous dissembling is not acceptable.  Nothing is worth that kind of lie - - not oil, not revenge, not reelection, not somebody's grand pipedream of a democratic domino theory.

 

 

 

 

 

And mark my words, the calculated intimidation which we see so often of late by the "powers that be" will only keep the loyal opposition quiet for just so long.  Because eventually, like it always does, the truth will emerge.  And when it does, this house of cards, built of deceit, will fall.

STATE OF THE UNION: THE BUSH TREASON

Last week, President Bush gave Congress his last State of the Union speech. Proving that the presidency erodes a man--he looked worn, haggard, colorless and beaten.  His words rang vacant, hollow and scratched like fingernails across the chalkboard of Americans' sense of honesty.

In truth, he looked every bit the part of a new book: "The Bush Tragedy" by Jacob Weisberg.  Newsweek reported, "As Bush's presidency nears its end, prospects for the Republicans look bleak…GOP candidates running in the wake of his wreckage can learn much from his failures…he squandered the peoples' trust."

On January 20, 2001, he raised his right hand and placed his left hand on the Holy Bible, "I do solemnly swear that I will faithfully execute the Office of the President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States."  (Article 2, section 1)  He repeated the same ceremony for a second time.

Concerning the basics of our U.S. Constitution: he lied to us, he violated his oath of office and created a boondoggle of a legacy as he mounted $3 trillion onto our national debt.  He oversaw the loss of millions of jobs, accelerating trade deficits and foisted a complete fraud on us as to national security from terrorism with his failure to secure our borders.

What about how he affected American families?  What did he do to us on a personal level?  What didn't he do to preserve, protect and enhance our lives?

I'll tell you how!  Last week, in Denver, Colorado, 21 year old U.S. Arm y soldier Duncan Crookston died after five months of misery.  He suffered both legs blown off, his right arm amputated and his left hand cut from his body.  He suffered horrific burns.  His young wife sat by his bedside for five months only to see Crookston's life slip away. 

That same sickening scenario repeated itself 3,900 times in the past six years since George Bush declared an unlawful war against a sovereign nation--after he strutted across an aircraft carrier with a banner that read, "Mission Accomplished!"  It means 3,900 family members trusted Bush to carry out his oath of office, but instead, he deceived them and us--into a vain war.  He maintains his corrupt war with no plan for withdrawal­ only more death and chaos.

One mother said, "Why is Bush preparing for his daughter's wedding while I plan for my son's funeral?"

While he prolongs his personal war in Iraq, he protects the Korean border with 35,000 U.S. troops while allowing millions of illegal aliens and uncounted terrorists full access across our southern borders for the past seven years.  Any president with a brain larger than a prairie dog's would have sealed our southern borders on 9/12/01 as the oath of office demands.

The other results of his Iraq War?  He poured $600 billion and up to $1 trillion down a rat hole in Iraq and Afghanistan that hasn't improved those countries one iota­ and hasn't caught Bin Laden or made this country safer.  He killed hundreds of thousands of civilians.  He inflamed the rest of the world against us.  Over 75 percent of the troops from ot her countries pulled out.  He's maimed and amputated 29,000 of our finest kids who trusted his felonious judgment.  Every year U.S. Army military suicides rise with 2007 topping at 121 kids.  Dr. William Polk, author of "Violent Politics" told Congress last week, "More than 500,000 of our troops will need a lifetime of mental health care following their multiple deployments in Iraq."

Bush spent 30 minutes insisting on how much progress we're making in Iraq.  Any drunken fool at a bar would lament, "What a crock of horse manure!"


In Michigan last week, Governor Jennifer Granholm begged companies and corporations to move to Michigan where she promised no taxes.  Her pleas resulted from Bush ignoring 3.1 million manufacturing and IT jobs leaving our country through insourcing, offshoring and outsourcing for the past seven years.

Fallout while Bush languished in the presidency: 1. Greatest fore closure fraud on housing in American history. 2. No national energy conservation policy. 3. No movement toward solving climate change. 4. No immigration policy that leads to a stable U.S. population. 5. Nothing advanced to employ 14 million unemployed Americans.  6. Horrific $9 trillion debt. 7. $3.50 a gallon gas. 8. Social Security, Medicaid and Medicare bankrupting.  9. War on Drugs a total and complete failure and waste of $560,000 billion during his watch. 10. Worked to dissolve America's borders by signing the Security, Prosperity Partnership that will destroy our sovereignty and force us into the North American Union with Canada and Mexico. 11. Patriot Act took away individual liberty.

George Bush's legacy stems from his lack of integrity.  Our predicament stems from his violation of his oath of office.  This country may not survive the aforementioned items not mentioned in his State of the Union address.   He proves himself the most inept, incompetent and disastrous president since the inception of this Republic. 

Are we appalled enough?  Are we incited enough to step up to the plate in the coming months by insisting on a president who values and upholds the sacred Constitution of the United States of America?

 Uh, does the following description sound like anyone we know? Perhaps the "decider-in-chief" in the White House?

"As Martha Stout explains, a sociopath is defined as someone who displays at least three of seven distinguishing characteristics, such as deceitfulness, impulsivity and a lack of remorse. Such people often have a superficial charm, which they exercise ruthlessly in order to get what they want. Stout argues that the development of sociopathy is due half to genetics and half to nongenetic influences that alf to genetics and half to nongenetic influences that have not been clearly identified." [From Publishers Weekly]

Oh yes, this description fits George to an "S." Although Stout's book -- unlike "Bush on the Couch" by Justin Frank -- is not about Bush per se, it does deal with Bush's most likely untreated psychiatric diagnosis: sociopathology.

Most crucially, Bush exhibits the linchpin of sociopathology: guiltlessnes, lack of remorse, absence of conscience.

And, once again -- as Justin Frank did -- Stout emphasizes the irony that people often can't believe that charming, flattering and amiable people can be sociopaths, when it is in the very nature of the pathology to win people over, while not caring a whit about them in reality.

As Stout writes in "The Sociopath Next Door": "If anything, people without conscience tend to believe that their way of being in the world is superior to ours." She also notes, "Socipaths are infamous for their refusal to acknowledge responsibility for the decisions they make, or for the outcomes of their decisions. In fact, a refusal to see the results of one's bad behavior as having anything to do with oneself -- 'consistent irresponsibility' in the language of the American Psychiatric Association -- is the cornerstone of the antisocial personality diagnosis.

Again, it is vital to remember -- and that is one of the main reasons Stout wrote the book -- that it is difficult to detect sociopaths in our midst because their lack of conscience is hidden behind a veneer of superficial affability.

That is the George W. Bush who has been inflicted upon America for the last six years. He is not the sociopath next door, which this books help you to detect if you are living next to one; he is the untreated sociopath with his hands on our ship of state.

Without remorse or conscience, he relentlessly steers the U.S.S. America straight toward an iceberg.
